We are seeking a detail-oriented and experienced Estate Paralegal to support our Personal Injury practice, with a primary focus on estate administration related to wrongful death and survival actions. The ideal candidate will have a strong understanding of New York Surrogate’s Court procedures, EPTL, and estate matters arising from personal injury litigation.
Key Responsibilities
- Prepare and file probate and administration petitions in New York Surrogate’s Court
- Assist with establishing estates for wrongful death and personal injury settlements
- Draft and manage estate-related documents, including:
- Petitions for Letters of Administration / Letters Testamentary
- Affidavits of heirship and family trees
- Waivers, consents, and citations
- Judicial settlement of accounts
- Coordinate with clients, next of kin, and fiduciaries regarding estate matters
- Track and calendar Surrogate’s Court deadlines and court appearances
- Obtain death certificates, tax ID numbers (EINs), and estate bank account documentation
- Assist attorneys with court approvals of settlements involving estates and distribute proceeds accordingly
- Communicate with other team members and assist in the resolution of Medicaid, Medicare, workers’ compensation, child support, and hospital liens related to estate cases
- Cooperate with and facilitate lien resolution and payoff documentation
- Maintain organized physical and electronic estate files
- Ensure compliance with New York EPTL, CPLR, and Surrogate’s Court rules
Qualifications
- Minimal experience as an estate or probate paralegal (NY experience required), but willing to train the right candidate.
- Proficiency with legal case management systems and e-filing preferred
- Strong organizational, communication, and time-management skills
- Ability to handle sensitive matters with professionalism and empathy
- Paralegal certificate or relevant degree preferred (not required if experience is strong)
- Bilingual in Spanish is ideal.
