Tax Lawyer

The Tax Lawyer is responsible in rendering opinions on various tax and corporate related issues to the company and to our clients and oversees tax-related activities such as tax investigation, and acts as corporate and tax advisors to clients. The Tax Lawyer supports the Legal & Finance Director and Management for the overall tax planning of the company. The Tax Lawyer must also ensure that all regulatory compliance requirements applicable to the Company and its clients are duly monitored and fully complied with in a timely manner.

DUTIES AND RESPONSIBILITIES:

  • Responsible for handling and responding to day to day operational queries on tax-related or corporate matters of internal and external clients.
  • Represent the company and its client with tax related disputes (like contest on assessment, tax evasion case, request for tax exemption and tax refunds) which involved preparation, review and analysis of contracts, position papers and protest letters and follow-ups and discussions with revenue officers on their findings.
  • Negotiate and resolve Tax Audit issues relative to Tax Assessment cases directly with government representative (BIR , LGU, PEZA, BOI etc.) with management direction.
  • Prepares detailed technical advice across a range of tax matters including international transactions, tax treaties, tax reform issues, merger and acquisition, corporate restructuring, and broad tax planning and compliance relative to new tax rules and regulation applicable to the company and its clients.
  • Applies knowledge of changing tax law, regulatory requirements and industry specific concerns to client engagements, identifies where they may impact a client and reflects these in their client work.
  • Uses knowledge of tax to discuss key issues with clients, local revenue authorities and other team members, including how to assess conflicting, ambiguous or inconclusive authorities.
  • Assists in the business organization, registration, post-registration, expansion, spin-offs, mergers, or closure and represented clients before government agencies such as the SEC, LGU, BIR, BSP, CDC, PEZA and BOI.
  • Keep confidential records and tax information for clients.
  • Interprets and applies key tax sources in order to carry out and document the results of tax compliance and advisory work.
  • Research and analyzes corporate and tax laws
  • Prepares complete and well-reasoned technical tax analyses.
  • Reviews correct tax analyses and tax computations or returns, provides tax compliance review as needed
  • Support HR and Finance Payroll Team in the Annualization and timely submission of 2316 of employees qualified for substituted filing
  • Coordinate with the external tax/legal/accounting/auditors engaged by the Company and its clients to ensure compliance with the required regulatory requirements

BASIC QUALIFICATIONS:

  • Candidate must be a member of the Integrated Bar of the Philippines, CPA is preferred but not required.
  • At least two (2) years of working experience in related field is required for this position.
  • Excellent command of written and spoken English and Filipino and comfortable to talk with foreign clients.
  • Must have a long-term plan to work and grow with the company
  • Has good interpersonal relations.
  • Has good organizational and managing skills, Compliance Specialist(s) will report directly to the Tax Lawyer
  • Ability to maintain a high level of confidentiality
  • Experience in dealing with government agencies
  • Understand financial statements, tax and accounting principles
  • Strong analytical and problem-solving skills, and detail-oriented
  • Ability to prioritize and manage time efficiently
  • Must possess good technical knowledge of domestic tax law and legislation, cases and jurisprudence, transfer pricing arrangements between companies.
  • Will work with Legal & Finance Teams and report directly to the Legal and Finance Head
  • Willing to work in Makati City.
